Abstract

The research problem is to define the optimal regulation of crypto-currencies in terms of efficiency. Applying the current Brazilian regulation as a point of reference, legislative proposals and hypotheses as alternatives; and, the methods offered by AED, Rational Choice Theory and by Game Theory as judgment criteria. A review of the literature on the object of research was established, defining its legal nature and variations in comparative law and practice; the methods of evaluating regulations and public policies, including the evolution from the proposals of Pigou and Coase to Stiglitz and Posner, and the failures of theories of public interestwere also covered by the theoretical foundation. The conclusion shows that the regulatory frameworks of greater freedom and guarantees of individual rights and free initiatives (broad and specific) are those that result in greater welfare and development.
