The theme of the present article, is the legal nature of the civil liability’s institute, applied to the dental professional, understanding their components, damage, fault and causation, taking as a basis the classical, objective and subjective theories. Searching with emphasis on Consumer Protection Code, it’s to comparatively analyze the physician and dentist’s obligation, in order to assimilate the difficulties better that involve its proper classification, as an obligation of means and results, be always attentive to the doctrine’s and jurisprudence majority’s positioning,
